A medico-legal case is one where besides the medical treatment, an investigation by the law enforcing Agencies is essential to fix responsibility regarding the present state condition of the patient.

 Ideally if required the case should be registered as medicolegal at your earliest. The case should be made medico-legal even if the patient is brought many days after the incident, however, there is no need of MLC registration if it’s already done at some other Hospital visited by the patient in the same case.

 In every MLC detail record of history, examination including general condition, level of consciousness, basic parameters and report of Investigation should be maintained and all Hospital papers, requisition, reports, X-ray films etc should be bear the word “MLC”

Information to police

In the following instances police has to be informed for the investigations and the legal actions:-

  • Injuries suspicion of crime/homicidal attempt
  • Firearm injuries
  • Suspected/evident sexual assault
  • Kidnapping and rape
  • Suspected criminal abortion
  • Girl less than 16 years requesting for MTP\
  • Suspected poisoning/ intoxication/addiction especially if violating NDPS act
  • Injuries/death during police firing/police interrogation
  • A lunatic patient
  • A dangerous operation to be done on an unconscious patient and there is no relative or friend of the patient
  • Discharge of an MLC against medical advice
  • Death of an MLC, already intimated to police, at admission
  • Dowry deaths
  • Unnatural unexpected unexplained death
  • Death due to drug reactions
  • Death due to blood transfusion reaction.
  • Death due to professional medical negligence
  • A patient does not pay the hospital bill
  • Bought death dead soon after admission (within 24 hours) when the cause of death is not established suspicion of the foul play.

In Big hospitals, the police officer is on duty around the clock. Information is sent in personal in legible writing using ball pen, avoiding overwriting and abbreviations mention all the necessary details and is sent in duplicate so that the original copy is written by the police officer and the initialed Carbon Copy is returned to the hospital.

The name, buckle number and the name of the police station of the police official receiving the information are noted.

If the medical officer is busy with the treatment of these or any other case, information can be given on the telephone and the detail of the police official receiving the call and noted on the hospital record of the case and the written information is sent later. If there is no police officer on duty in the hospital, the information is sent to the concerned police station.
